12/11/2000 - urgent update !!!! Class Action Lawsuit against Network Solutions!!! Deadline is 12/20/00
Dear Member of the Proposed Class:
I am writing you because you are one of the people who have contacted me or my partner, Scott Powell and expressed your interest and/or offered your assistance in this case. We are seeking a court order to require Network Solutions to release the expired domain names. We believe the best way to acheive this result is through a class action that points out the nationwide extent of Network Solutions actions.
We have received your e-mails from all around the Country. The complaint has been filed. Network Solutions has answered the complaint. The Court entered a very tight scheduling order. And discovery has begun. We are under an extremely tight deadline, imposed by the Court to file our motion for class certification by December 20th.
A small effort on your behalf can greatly help the cause of getting the case certified. To indicate to the Court the extent of Network Solutions wrongdoing, we would like to obtain affidavits from around the country of people who tried to register expired domain names. The affidavit would simply include: your name, where you live, your age, what expired name(s) you tried to register, when you tried to register the name(s) and the result of your attempt. If you have any documentation of your attempt, it would be helpful to attach it to the affidavit.
If you are willing to sign such an affidavit or provide additional evidence of NSI's domain name hoarding, please contact me ASAP at 800-568-5330. If I am not in the office, please ask for my secretary, Lynne Reed. Lynne will take your name and number and locate me so that I may respond to you as quickly as I can. Today is your chance to help take on a giant and help force an end to the hoarding of expired domain names.
I have attached copies of both the complaint and the scheduling order. The Complaint is in .pdf format. You will need the adobe acrobat reader to read the documents. You can download it for free off the net if you do not already have it. The scheduling order is in a multipage Tiff format that you can read with Windows.
I look forward to hearing from you.
